Terms

  • PAYMENT FOR SERVICES: Energy ESI requires payment  of balance IN-FULL for all events and services, one (1) week in advance of event. It is the sole responsibility of Client to insure that the balance is paid in full. We must receive payment in advance unless otherwise agreed upon in writing.  If balance IN-FULL has not been paid one week in advance, Energy ESI may choose to cancel client's contract, keep the non-refundable retainer, and not perform work. Payments can be made by credit, check card, e-check, personal check, company check, money order or cash. No third party or out-of-state checks will be accepted. We take CASH payments ONLY at our office. No cash is to be given to the DJ, except for tips. Overtime rate ($100 to $175 per hour) is due and payable by check to Energy ESI prior to the start of overtime. A $25 charge is added to all returned checks. A $75 fee is charged for additional insured certificate requests.

  • RETAINERS: A non-refundable ($100-$400) retainer is required by all events and services and must be paid at time of booking. Retainers can be made at our office during normal office hours, at our website, or by mail. Your booking is NOT considered complete without your retainer. We have the right to deny your booking if we have not received your retainer in a timely manner or have booked all of our DJ's prior to receiving your retainer. If Client cancels within 7 weeks (49 days) of the event date, Client agees to pay the full balance within seven (7) days of the original event date. In the event a collection process is initiated by Energy ESI, Client agrees to pay normal attorney fees and court costs. A booking can be postponed for any reason and rescheduled up to one year from the original date of event without forfieting retainer, however, the DJ for the event may not be the same. If the location or time duration differs from the original booking, the price will be adjusted accordingly.

  • SITE REQUIRMENTS: For insurance reasons, no one except the DJ(s) are allowed to move/handle equipment including speakers, mixers, players and cd's or to be behind the DJ booth. For any events where the DJ(s) needs to use a flight of stairs to carry equipment, a $50 charge will be added to the normal price. A flight of stairs is defined as a staircase consisting of at least three (3) steps. DJ(s) must have direct and easy access to the performance/dance floor area as well as use of a restroom. Client is required to move all obstacles for DJ(s) equipment and provide restroom. A power source must be located within 25' of the DJ booth or power extension must be provided by client. If outside, the DJ(s) requires a 5'X 5' level cemented shaded or covered area with no grass, dogs, or surrounding pools adjacent to the DJ booth. The DJ(s) cannot be located in direct sunlight. During outdoor night events, the DJ(s) will not be located near a fireplace or pit and smoke/ash may not be directed in DJ's path. If so, the DJ(s) is allowed to stop work until the situation is corrected. The DJ(s) have the final say on alternate performance location if location is deemed by DJ(s) to be inappropriate. If the client or client's representative is not present when the DJ (s) arrives at the event to set-up, the DJ(s) will place equipment where they deem appropriate. If after setting up and asked to move, a $50 fee will be charged.

  • PAPERWORK REQUIREMENTS: It is important that events are booked as early as possible. It is the sole responsibility of the client to submit all required paperwork correctly and accurately to the DJ(s) in a timely manner. The DJ(s) will not be responsible for paperwork omissions. Booking Forms, Planning Forms, Timelines, Diagrams, Songlists, ect., must be submitted at least three (3) weeks prior to the event. If the DJ(s) do not receive a completed Itinerary with song selections and timeline three (3) weeks prior to event, the DJ(s) will not be resposible for any problems you encounter at your event. If you deviate from the established itinerary for any reason, the DJ(s) will not be held responsible for any problems you encounter at your event. If the DJ(s) do not receive Songlists at least three(3) weeks prior to the event, the DJ(s) will not be responsible for providing/playing the requested songs. Client is to choose songs for a playlist from our music database ONLY. Any song not listed in our music database and required by client, must be provided by client. We cannot guarantee that home cd's will play on our professional systems. Client is responsible for retrieving and cd's/dvd's/mp3's supplied to us. Time changes for entertainment must be in writing. No verbal time changes will be accepted. Once you have booked our services by submitting and event order form and paying deposit, we cannot reduce price for reduction of hours. Any additional hours required over the quoted price will be subjected to our overtime policy.

  • DJ REQUIREMENTS: DJ(s) are to start at agreed upon times. If the DJ is late, we will deduct the pro-rated share up to forty-five (45) minutes. If the DJ is more than 45 minutes late, we will not charge you for our service. DJ(s) are to maintain a professional attitude while working at all times. The DJ(s) are not allowed to use foul language at any time during an event. If so, the DJ is subject to termination by Energy ESI. If the DJ is working three (3) hours or more, we ask you to provide him/her a meal and drink. If the DJ is not provided a meal at no cost, we will charge a $25 fee. DJ(s) are not allowed to drink alcoholic beverages two (2) hours prior to an event, during an event, or in transit to our offices from an event. The DJ must be sober at all times while driving and handling equipment. DJ(s) bring to their events up to four (4) speakers, up to four (4) cordless (handheld NOT lapel or lavalier) microphones , and up to two (2) special effect lights. DJ(s) also have corded microphones as back-up in case of interference or other problems with cordless mics. The DJ will use his/her best judgement in troubleshooting any on-site problems and utilize back-up equipment when necessary. If, for some reason, both lighting systems fail, we will deduct/refund the client $50. In the case of any disorder, dispute, disruption, or sexual harrassment at the event in progress, which could result in injury to the DJ(s), they, in their judgement, may terminate performance without liability or refund. Also included, but not limited to, any equipment failure, accident, act of God, riot, strike, any act of a public authority or any similar cause beyond our control. In the instance where any public autority has requested that music sound levels to be turned down due to complaints, the DJ(s) shall comply. If the public authority returns a second time due to continued complaints, the DJ(s) shall terminate performance. Any damage to equipment or theft by party guest(s) shall be the responsibility of client.

OTHER REQUIREMENTS:

  • We can accommodate any presentations, singers, performers, bands or emcee's that you have hired outside our services by providing our microphone and sound system to them at your event. However, please be informed that we require advance notice of your intent and that there is an additional $150.00 charge for this service. Last minute changes will NOT be accepted.

  • If your music selections or desired genre of music payable at your event contains Rap and/or Hip-Hop, we can not guarantee that what is played at your event is the "edited" or clean version of the song.  This music often contains violent and sexual content and Energy ESI is no way takes responsibility for content.  Client takes full responsiblity for any complaints, civil or otherwise, by making such selections of music.

  • Under no circumstances will the client make any attempt to directly book any DJ(s) provided by Energy ESI for a period of three (3) years. Likewise, no subcontract or directly employed DJ(s) of Energy ESI will book directly with any contracted client for a period of three (3) years.

  • Energy ESI will not contract for services with minors nor will Energy ESI allow minors to instruct our DJ's during the course of contracted performance. If Energy ESI is performing services for minors, the adult(s) that contracted for services must be present at all times.

  • Our current pricing for Photography & Videography Services are considered to be Introductory & deeply discounted. In exchange, Client gives Energy ESI permission to use images for promotional purposes.

  • Photo Album prices as listed on the "Prices" page of this website include one 8.5" X 11" hardback bound book of UP TO 65 glossy white pages.  Once the client has approved pictures for inclusion in the album, it is understood that the placement and design of the album is left soley to the discretion of Energy Events.  We can not "redo" albums once they have been completed.

  • It is understood that the "CONTRACT FOR SERVICES" entered into by the Client & Contractor is legal & binding.  It can not be altered or changed unless agreed to in writing by both parties. It is the responsibility of the Client to fully understand and comply with our terms. It is recommended that our clients print a copy for their reference.
